Article 1 - General provisions
These General Terms and Conditions of Sale apply exclusively to the online sale of products offered by the company The Ether Company SAS under the trade name Aeternum via the site https://aeternum.fr.
The General Terms and Conditions of Sale are made available to clients on the Site where they can be directly consulted and can also be provided upon simple request by any means.
The General Terms and Conditions of Sale are binding on the client who acknowledges, by checking a box or clicking the button provided for this purpose, that they have read and accepted them before placing an order. Confirming the order constitutes the buyer's acceptance of the General Terms and Conditions of Sale in effect on the day of the order, which are stored and reproduced by The Ether Company SAS.
Article 2 – Products
https://aeternum.fr is an online sales site for wellness, decoration, and esotericism products (hereinafter the "Product(s)") open to any natural or legal person using the Site https://aeternum.fr (the "Client").
The Products presented on the Site each have a description mentioning their essential characteristics.
Photographs illustrating the products, if any, do not constitute a contractual document.
The Products comply with the applicable French law.
The Client remains responsible for the terms and consequences of their access to the Site, especially via the Internet.
They acknowledge having verified that the computer setup they use is secure and operational.
Article 3 – Orders
Aeternum strives to ensure optimal availability of its Products. Offers are valid while stocks last.
If a Product is found to be unavailable after the order, Aeternum will inform the Client by email as soon as possible.
The Client may then choose between:
- the delivery of a Product of equivalent quality and price;
- or the refund of the price of the ordered Product within a maximum period of thirty (30) days.
Orders are firm and final, subject to the right of withdrawal provided by law.
The information provided by the Client when placing the order binds them.
Aeternum cannot be held responsible for any error preventing or delaying delivery.
Article 4 – Payment methods and security
The Client expressly acknowledges that any order placed on https://aeternum.fr is a binding order requiring payment, which involves paying a price in exchange for the delivery of the ordered Product.
In any case, Aeternum reserves the right to verify the validity of the payment before shipping the order, by any necessary means.
Orders can be paid using one of the following payment methods:
- Payment by bank card. Payment is made directly on the secure servers of the payment provider; the Customer's bank details do not pass through the Site. The bank details provided during payment are protected by an SSL (Secure Socket Layer) encryption process. In this way, these details are not accessible to third parties.
- Deferred payment with Klarna. The payment period is 30 days from the shipment of the goods. To view the full general conditions of this payment method, click here.
- Payment in 3 installments without fees with Klarna (available for orders from €35.00 excluding shipping costs). Your first payment will be collected when your order is shipped, and payments 2 and 3 are scheduled respectively 30 and 60 days later. For more information on this payment method, click here.
- Payment via PayPal. The Customer can pay for their order via PayPal, up to a maximum amount of €250.00 per order. PayPal's terms of use apply and are exclusively governed by PayPal. When PayPal offers an installment payment option (including payment in 4 installments), this option depends solely on PayPal, which decides its display, acceptance, and terms. Aeternum cannot activate, guarantee, or modify this feature.
The Customer's order is recorded and validated as soon as payment is accepted by the payment provider.
The Customer's account will be debited for the corresponding amount only when the data of the bank card used has been verified and the debit has been accepted by the bank that issued the bank card.
The inability to debit the amounts due will result in the immediate cancellation of the sale.
The bank card may be refused, in particular if it has expired, if it has reached the maximum spending limit allowed to the Customer, or if the entered data is incorrect.
Article 5 – Payment of the price
The price of the Products in effect at the time of the order is indicated in euros, all taxes included (TTC), excluding delivery and shipping fees. In case of a promotion, Aeternum commits to applying the promotional price to any order placed during the advertising period for the promotion.
The price is payable exclusively in euros (€). The price is due in full after order confirmation. The prices offered include any discounts and rebates that Aeternum may grant.
If delivery or shipping fees apply, they will be added to the price of the Products and indicated separately before the Customer validates the order. The total amount due by the Customer and its breakdown are shown on the order confirmation page.
Article 6 – Contract formation
The contract between Aeternum and the Customer is formed at the moment the Customer sends the order confirmation.
The Customer's attention is particularly drawn to the order acceptance method on https://aeternum.fr. When the Customer places an order, they must confirm it by the "double-click" method, meaning that after selecting Products added to the cart, the Customer must check and possibly correct the cart contents (identification, quantity of selected products, price) and acknowledge acceptance of the Terms and Conditions of Sale. They then click on "Payment" to enter their personal data necessary for order processing before validating it by clicking on " Continue to shipping method ". Then they will choose their delivery method and click on " Continue to payment method ". Finally, they confirm their order after entering their banking details. The "double click" counts as an electronic signature and is equivalent to a handwritten signature. It constitutes an irrevocable and unconditional acceptance of the order by the Customer.
Article 7 – Retention of title
Aeternum remains the exclusive owner of the Products ordered on https://aeternum.fr until full payment of the price, including any shipping fees.
Article 8 – Shipping and deliveries
Orders are prepared and shipped within a maximum of 48 business hours, excluding weekends and holidays, subject to payment validation.
Shipments are handled by third-party carriers (Colissimo or Mondial Relay) to the address provided by the Customer.
Delivery times are indicated in business days and correspond to average observed times. They are given for information purposes only.
8.1 Delayed or untracked package
A package is considered abnormally delayed when no tracking update is observed within 15 business days after the shipping date.
In this case, the Customer is invited to contact customer service so that a investigation can be opened with the carrier.
8.2 Carrier investigation
The investigation can last up to 30 calendar days from its opening.
During this period, no reshipment or refund can be made, unless otherwise decided by Aeternum.
At the end of the investigation:
- if the package is found, it will be redirected to the Customer;
- If the package is declared lost, the Client may choose between a full refund or a free reshipment (subject to the availability of the products concerned).
8.3 Relay Point Delivery
For relay point deliveries, the Client is required to collect their package within the time limits set by the carrier.
Any package not collected and returned to the sender may be refunded excluding delivery fees.
8.4 Claims and Disputes
In case of delivery issues, the Client is invited to contact customer service before opening a dispute with a payment platform (PayPal, Klarna, ...).
Any unjustified or abusive claim/chargeback will automatically result in a complaint being filed.
Article 9 – Right of Withdrawal
If a delivered Product does not fully satisfy the Client, the latter may return it to Aeternum, provided it has not been opened, damaged, and/or consumed. The Client will have fourteen (14) days to do so from the day after the order receipt date. The Client must send an email to commande@aeternum.fr specifying the order number and the reason for the return, or do so directly via the client area. Aeternum will send the return procedure to the Client to print the return slip.
Return shipping costs will be borne by the Client and will be deducted from the refund amount.
Refunds are made within fifteen (15) days after receipt and will be automatically credited to the account associated with the credit card used for the purchase.
By accepting these General Terms of Sale, the Client expressly acknowledges having been informed of the exchange and withdrawal procedures.
Article 10 – Intellectual Property and Site Usage License
Aeternum is the sole owner of all elements on the Site, including but not limited to all texts, files, animated or static images, photographs, videos, logos, drawings, models, software, trademarks, visual identity, database, Site structure, and all other intellectual property elements and other data or information (hereinafter, the "Elements") which are protected by French and international laws and regulations relating notably to intellectual property.
As a result, none of the Site Elements may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, displayed, stored, used, rented, or exploited in any other way, free of charge or for a fee, by a Client or by a third party, regardless of the means and/or media used, whether known or unknown to date, without the prior express and written authorization of Aeternum on a case-by-case basis, and the Client is solely responsible for any unauthorized use and/or exploitation.
Aeternum reserves the right to take all legal action against persons who have not respected the prohibitions contained in this article.
Article 11 – Liability and Warranty
Aeternum remains responsible for the proper execution of the contract until the Product is effectively delivered to the Client.
The Products benefit from the legal guarantees of conformity and hidden defects provided by law.
Aeternum cannot be held responsible for cases of force majeure or unforeseeable and insurmountable acts by a third party.
Article 12 – Personal Data
The User is hereby informed that the personal data marked as mandatory on the forms and collected as part of the service described herein are necessary for the use of the Site. Among the User's personal data collected by the Operator may be:
- Their first and last names
- Their email address
- Their postal address
- Their phone number
- Their IP address (virtual address of their computer)
- Their password
Aeternum commits to ensuring the protection of the Client's personal data and all personal data obtained in connection with the use of the Site's services.
As such, each Client is solely responsible for maintaining the confidentiality of their username and password and is solely responsible for all access to their Client Account, whether authorized or not.
Aeternum cannot be held responsible for any harmful action or fact carried out via the Client's personal space by a third party who gained access to their login credentials and password due to a fault or negligence attributable to the Client. The Client agrees to inform Aeternum immediately as soon as they become aware of or suspect unauthorized use or access to their personal space.
All personal data collected by Aeternum is gathered directly from the Client and processed by Aeternum to enable the implementation and management of the Site's services. This data may also be used to develop statistics to improve the Site's services. This data may be transmitted to Aeternum's partners and suppliers involved in the delivery, billing, and management process for order processing as well as for marketing and customer relationship management purposes.
Article 13 – General provisions of the parties' agreement
These General Terms and Conditions constitute a contract governing the relationship between the Client and Aeternum. They constitute the entirety of the rights and obligations of the Company and Aeternum related to their subject. If one or more provisions of these General Terms and Conditions are declared null under a law, regulation, or following a final decision of a competent court, the other provisions will retain their full force and effect. Furthermore, the fact that one party to these General Terms and Conditions does not invoke a breach by the other party of any of the provisions of these General Terms and Conditions shall not be interpreted as a waiver on its part to invoke such a breach in the future.
Article 14 – Modification of terms
Aeternum reserves the right to modify at any time and without notice the content of the Site or the services available thereon, and/or to temporarily or permanently cease operating all or part of the Site.
Furthermore, Aeternum reserves the right to modify at any time and without notice the location of the Site on the Internet, as well as these General Terms and Conditions. The Client is therefore required to refer to these General Terms and Conditions before any use of the Site.
The Client acknowledges that Aeternum cannot be held liable in any way towards them or any third party due to these modifications, suspensions, or terminations.
Aeternum advises the Client to save and/or print these General Terms and Conditions for safe and lasting keeping, so they can be invoked at any time during the execution of the contract if needed.
Article 15 – Applicable law
These General Terms and Conditions are governed, interpreted, and applied in accordance with French law.
Article 16 – Acceptance of the General Terms and Conditions by the client
The Client acknowledges having carefully read these General Terms and Conditions.
By registering on the Site, the Client confirms having read the General Terms and Conditions and accepts them, thereby becoming contractually bound by the terms of these General Terms and Conditions. The General Terms and Conditions applicable to the Client are those available on the date of the order, a dated copy of which can be provided to the Client upon request. It is therefore specified that any modification of the General Terms and Conditions made by Aeternum will not apply to any order placed previously, except with the express agreement of the Client who placed the given order.
