General Terms and Conditions of Sale
Find here our updated General Terms and Conditions of Sale regarding our delivery methods, payment options, order preparation, and much more.
Article 1 – Seller Identity and Scope
The Site aeternum.fr is operated under the trade name Aeternum by The Ether Company SAS, a simplified joint-stock company with share capital of €3,000, registered with the Paris Trade and Companies Register under number 949 286 967, whose registered office is located at 40 rue Alexandre Dumas, 75011 Paris, France. Its individual VAT number is FR83949286967.
Aeternum may be contacted by mail at the registered office address, by telephone at 09 79 10 29 48, or by email at commande@aeternum.fr.
These general terms and conditions of sale, hereinafter the “Terms and Conditions of Sale,” govern retail sales concluded on the Site with any individual acting for purposes outside their commercial, industrial, craft, professional, or agricultural activity, hereinafter the “Customer.” Purchases intended for resale or made in connection with a professional activity are subject to separate professional terms and conditions of sale.
The Customer may view, save, and print the Terms and Conditions of Sale before placing an order. Validating the order constitutes acceptance of the Terms and Conditions of Sale in force on that date.
Article 2 – Products, Information, and Availability
The products offered for sale are presented on the Site with their main characteristics, price, and, where applicable, their conditions of use and warnings. The Customer must review them before placing an order.
The photographs are intended to represent the products faithfully. Natural materials, handcrafted production, print runs, and packaging may present slight differences in color, shape, texture, or appearance, without altering the nature or advertised characteristics of the product.
Information concerning historical, religious, spiritual, or ritual uses is provided for cultural and practical purposes. It does not constitute a diagnosis, treatment, or promise of results. No result related to the use of an esoteric or ritual product can be guaranteed. Products do not replace medical advice or treatment. The Customer must follow the labeling, usage precautions, and intended use indicated on each product page.
Offers are valid while stocks last. If a product becomes unavailable after the order is placed, Aeternum will inform the Client without delay. No replacement product will be sent without the Client’s express consent. The Client may accept an equivalent product proposed by Aeternum or receive a refund for the unavailable product.
Article 3 – Regulated Products and Destination-Related Restrictions
Products restricted to adults
The sale of bladed weapons classified as Category D, which may include certain athames, daggers, or swords, is restricted to adults. Aeternum may request proof of age before shipping and cancel the sale if adulthood cannot be verified.
The acquisition and possession of a Category D weapon by an adult are unrestricted in France, but carrying and transporting it outside the home require a legitimate reason. The Client remains responsible for complying with the rules applicable in their country or territory of residence.
Certain products cannot be shipped to all destinations due to their nature, dimensions, carrier rules, or local legislation. The shipping methods available at checkout therefore depend on the contents of the basket and the delivery address.
Article 4 – Prices, Currencies, Taxes, and Import Fees
The applicable prices are those displayed on the Site at the time of the order, in the currency corresponding to the selected market. The Site may display prices in euros, Swiss francs, Canadian dollars, or United States dollars. The billing currency and the total amount payable are indicated before final confirmation.
For destinations subject to European Union VAT, prices are displayed inclusive of all taxes in accordance with the applicable tax rules. For a destination outside the European Union’s tax territory, the tax regime applied depends on the delivery address and the regulations in force.
Unless otherwise stated at checkout, customs duties, import VAT, the octroi de mer tax, local taxes, and the carrier’s processing fees are not included in the amount collected by Aeternum. They may be claimed from the recipient by the authorities or the carrier.
Delivery charges are added to the product prices and displayed before the order is confirmed. They vary according to the destination, weight, basket contents, and selected shipping method.
Article 5 – Ordering and Contract Formation
The Customer selects the products, checks the contents of their cart, enters their contact details, chooses the delivery method and payment method offered for their destination, then reviews the order summary and its total price. They may correct any errors before final confirmation.
Confirmation using the button indicating an obligation to pay constitutes final confirmation of the order. The contract is concluded when Aeternum sends the Customer electronic confirmation of the order.
The Customer must provide accurate and complete information. An error in the address, postal code, country, telephone number, email address, or choice of pickup point may delay or prevent delivery.
Aeternum may refuse or cancel an order for a legitimate reason related to suspected fraud, an unresolved payment incident, an unusual request, a legal restriction, or a product being unavailable. Any amounts already collected for canceled products will then be refunded.
Article 6 – Payment
Payment methods offered for the order
Bank card, Shop Pay, Apple Pay, PayPal, Klarna, or Bancontact. The payment methods actually available are displayed at checkout according to the country, amount, and device used.
Payments by card or electronic wallet are processed by secure service providers. Aeternum does not receive the complete bank card number. The order is shipped only after payment has been validated.
The products remain the property of Aeternum until the price and associated fees have been paid in full.
Article 7 – Delivery zones, methods, and fees
Aeternum currently ships to metropolitan France, Germany, Belgium, Spain, Italy, Luxembourg, Monaco, the Netherlands, Portugal, Switzerland, Guadeloupe, French Guiana, Réunion, Martinique, Mayotte, New Caledonia, Saint Barthélemy, Saint Martin, Canada, and the United States.

Only the shipping methods displayed at checkout are available for the cart and address concerned. Detailed information is also provided on the Shipping Methods page.
Article 8 – Order Preparation and Delivery Times
Unless otherwise stated on a product page or at checkout, orders are prepared within one to two business days after payment validation. Saturdays, Sundays, and public holidays are not counted.

- Chronopost Express: delivery by 1 p.m. on the next business day for an eligible order paid for and validated before 2 p.m. on a business day.
For the serviced European destinations, the delivery time announced after dispatch is three to seven business days with Colissimo and four to eight business days with Mondial Relay when this service is available. For the serviced overseas territories, the delivery time announced after dispatch is seven to ten business days with Colissimo.
For New Caledonia, Canada, and the United States, the delivery time or period communicated at checkout or in the order confirmation applies. Customs formalities may extend the transit time.
Article 9 – Delays, Loss, Receipt, and Transfer of Risk
Aeternum is responsible for properly carrying out the delivery until the product is physically taken into possession by the Customer or by a third party designated by the Customer, other than the carrier. This rule does not apply when the Customer independently chooses a carrier not offered by Aeternum.
In the event of a delay or interruption in tracking, the Customer may contact Aeternum so that an investigation can be opened with the carrier. If the package is declared lost, Aeternum will offer, depending on the Customer’s choice and product availability, a free reshipment or a refund for the affected products.
Upon receipt, the Customer is invited to check the condition of the package and the products. In the event of damage, a missing item, or an error, photographs of the package, the shipping label, and the products may be promptly sent to commande@aeternum.fr to facilitate processing.
Article 10 – Pickup Point, Incorrect Address, and Returned Package
For delivery to a pickup point or locker, the Customer must collect the parcel within the period communicated by the carrier. The choice of pickup point may be made after payment when provided for by the carrier’s process.
If the parcel is returned to Aeternum because of an incorrect or incomplete address provided by the Customer, failure to collect it within the applicable period, or refusal to pay legally required import charges, no automatic reshipment will be made. After the return to Aeternum’s premises has been confirmed, the Customer must contact customer service to indicate whether they wish to have the order reshipped or cancelled. Reshipment will take place after payment of the applicable delivery costs.
If cancellation is requested following a return attributable to the Customer, any refund will be made after the parcel has been received and inspected. Subject to mandatory legal provisions, the initial delivery costs incurred and the return costs charged to Aeternum remain the Customer’s responsibility. The refund covers the value of the products actually recovered. Missing or damaged products attributable to the Customer will not be refunded to the extent of the loss in value established, within the limits provided by law.
Refusing the parcel or failing to collect it is not sufficient to exercise the right of withdrawal. The Customer must send a statement clearly expressing its decision.
Article 11 – Right of withdrawal
11.1 Period and exercise
The Customer has fourteen calendar days from the day after receiving the product to exercise the right of withdrawal, without having to give a reason. For an order delivered in several parcels on different dates, the period begins on the day after receipt of the last parcel.
Before the deadline expires, the Customer must inform Aeternum of its decision using the form attached, by post sent to The Ether Company SAS – Aeternum, 40 rue Alexandre Dumas, 75011 Paris, France, or by email sent to commande@aeternum.fr, or any other unequivocal statement.
11.2 Returning the products
After being notified of its decision, the Customer must return the products no later than fourteen days later, to the address and in accordance with the instructions provided by Aeternum. The direct costs of the return remain the Customer’s responsibility, unless Aeternum offers to cover them or the return concerns a non-compliant preparation, transport damage, or a defect covered by a statutory warranty.
When the Customer arranges the return themselves, they are responsible for choosing an appropriate shipping method, properly protecting the products, retaining proof of drop-off and tracking, and sending the parcel to the address provided by Aeternum. Except where the return is handled or arranged by Aeternum, and subject to the mandatory rules applicable to the right of withdrawal and legal guarantees, the Customer assumes the consequences of inadequate packaging and must pursue any available claim against the carrier they have chosen in the event of loss or damage.
11.3 Refund
Aeternum refunds the payments received for the returned products, as well as the standard delivery costs corresponding to those products, no later than fourteen days after being informed of the withdrawal. Aeternum may defer the refund until it has recovered the products or until it receives proof that they have been shipped, whichever occurs first.
11.4 Exceptions
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer’s specifications or clearly personalized goods, goods that are likely to deteriorate or expire rapidly, or sealed goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.
Article 12 – Legal guarantees
Aeternum pays particular attention to the quality, description, and preparation of the products offered. If a product has a defect that does not correspond to the advertised characteristics or prevents normal use, the Customer is invited to contact customer service promptly so that an appropriate solution can be sought.
Legal guarantee of conformity
In accordance with Articles L. 217-3 to L. 217-20 of the French Consumer Code, a consumer Customer has two years from delivery of the product to request enforcement of the legal guarantee of conformity when a defect covered by this guarantee is discovered.
After reviewing the request, the product covered by the warranty may be repaired or replaced, depending on the solution provided by law and appropriate to the nature of the product. This service is provided free of charge to the Customer and within a maximum period of thirty days from the date of the request.
When repair or replacement cannot be carried out under the conditions provided by law, a price reduction or rescission of the sale may be offered. Rescission of the sale does not apply when the defect is minor.
The statutory warranty of conformity does not cover normal wear and tear, deterioration occurring after delivery, improper use, failure to follow precautions or warnings, improper storage, an accident, or modification of the product by the Customer or a third party. It does not constitute a right to an exchange or refund in the event of a mere change of mind or dissatisfaction without a product defect.
Warranty against hidden defects
The Customer also benefits from the warranty against hidden defects provided for by Articles 1641 to 1649 of the French Civil Code. They have two years from discovering the defect to bring a claim and may, subject to the legal conditions, keep the product in exchange for a price reduction or return it for a refund.
To request assistance, the Customer contacts Aeternum at commande@aeternum.fr by stating the order number, the product concerned, and the difficulty encountered. Photographs and any useful information may facilitate the review of the request. Aeternum may request the product’s return or any necessary inspection to determine the origin of the issue and the applicable solution.
Article 13 – Liability and force majeure
Aeternum assumes its contractual responsibilities under the conditions provided by law and carefully addresses any difficulty directly related to the fulfillment of the order. These General Terms and Conditions of Sale are applied in accordance with the mandatory rights relating to sales, delivery, the right of withdrawal, and statutory warranties.
Aeternum is not liable for improper use of the product, failure to follow the warnings, use for a purpose other than its stated intended purpose, or any modification made by the Customer. The absence of a result from a spiritual or ritual practice does not constitute a product defect.
Neither party may be held liable for a failure caused by an event meeting the conditions of force majeure defined in Article 1218 of the French Civil Code.
Article 14 – Personal data
The Ether Company SAS processes the data necessary to manage accounts, orders, payments, deliveries, returns, customer relations, fraud prevention, and its legal obligations. Data necessary to fulfill the order may be transmitted to payment service providers, carriers, technical partners, and authorized authorities.
The purposes, legal bases, retention periods, recipients, and the Customer’s rights are presented on the Personal data page. The Customer may exercise their rights by contacting Aeternum. They may also lodge a complaint with the CNIL.
Article 15 – Intellectual Property
The texts, photographs, illustrations, videos, trademarks, logos, graphic elements, databases, and structure of the Site are protected by intellectual property laws. Any reproduction, adaptation, extraction, distribution, or use beyond the private use permitted by law requires the prior written authorization of the rights holder.
Article 16 – Complaints and Amicable Dispute Resolution
In the event of a difficulty, the Customer is invited to submit a written complaint to Aeternum by post at The Ether Company SAS – Aeternum, 40 rue Alexandre Dumas, 75011 Paris, France, or by email at commande@aeternum.fr. To facilitate efficient processing, the request must state the order number, the relevant facts, and any information useful for verifying them. Aeternum carefully reviews each complaint and seeks an amicable solution suited to the situation.
Article 17 – Applicable Law and Competent Jurisdiction
The Terms and Conditions and contracts concluded on the Site are governed by French law. For a Customer residing in another country, this choice does not deprive them of the mandatory protections they are entitled to under the law of their country of residence where applicable.
In the absence of an amicable agreement, the dispute shall fall under the jurisdiction of the competent courts in accordance with the applicable procedural rules.
Article 18 – Amendment, Severability and Evidence
Aeternum may amend the Terms and Conditions for future orders. The applicable version is the one accepted on the date of the order. A subsequent amendment does not alter a contract already concluded without the Customer's consent.
If a clause is declared null and void or unenforceable, the other clauses shall remain in effect. Failure to invoke a clause immediately does not constitute a waiver of the right to invoke it subsequently.
Order confirmations, emails, payment data, and records stored in Aeternum's or its service providers' systems may serve as evidence of communications and transactions, subject to the Customer's right to dispute their accuracy.
